Double Advantages For The Disabled

Saturday, January 16, 2010

Disability is the worst thing that may happen to a working individual. It limits the chance of a man to take his career anywhere. However, just because you have become disabled, the civil society does not give up on you. Instead you get the best care and special benefits in the form of Worker’s Compensation and Social Security Incapacity Benefits. What is more, you can claim the two of these together.

As per many laws of United States a disabled person is entitled to both Social Security Disability Benefits and Worker’s Compensation benefits claim at the same time. This is often availed if a working individual becomes disabled due to diverse reasons during his/her term of service. Though both theses policies can be used at the same time, they’re different in nature and content. Henceforth, the procedures for these benefits differ from another. The benefit of Social Security Incapacity has been formulated by the governing body of US. As a result these laws stay the same for the entire country. On the other hand, rules for the worker’s compensation are dissimilar for every state. This is as Employee’s Compensation laws fall in the domain of the state and thus varies accordingly. So it is kind of apparent that Alaska and Texas could have different laws from Maryland and California.

Even though the Employee’s Compensa-tion is a state run program, it depends on some basic principles. In a majority of the fifty states, you can claim up to 2/3 of your gross [ pre tax ] earnings from your employer. Sometimes the corporations run a worker’s compensation insurance plan to address such an eventuality. The money therefore comes from insurer’s pocket. Keep in mind though that there’s cap on the amount that you can get as compensation in any explicit year. Generally this is selected a case to case basis.

Social Security Incapacity Benefits are fixed and delivered as per the instructions of US govt. There are fixed top limits and defined types of incapacity which are covered in the program.

What is important is that both these benefits need regular checkups of your fitness. You will stop getting benefits when you are considered healthy enough to restart work.

Subsequently if you want to file for both claims you want to make contact with a Worker’s Compensation lawyer. This is basically to help with the timing issues of claim filing as sometimes, one may impact the other. Generally you would need only one lawyer to handle both sorts of claims; however, some of the counsels focus on either Social Security or Employee’s Compensation claims solely, where you will have to engage two and have them coordinate.

It may seem a little tricky to believe ; however it is always preferable to appoint two different attorneys. This is so because each can work in the area of his/her own specialization without troubling to look after everything. Both will look after the 2 claims individually and this would in turn prove to be an efficient deal on the whole.
